Copyright and Trademark Infringement Reporting Requirements

Cozymoo respects the intellectual property rights of others and asks that users of the Site or the Site (also) comply with this. We will respond to notices of alleged copyright infringement in accordance with applicable law. In addition to other remedies, we may, in appropriate circumstances and at our sole discretion, terminate, discontinue, suspend and/or restrict accounts/profiles, or restrict access to and/or use of the Service by users who infringe the intellectual property rights of others, and we may choose to remove, delete, erase or disable access to content deemed to be infringing.

DMCA Policy and Copyright Infringement

If you have reason to believe that your Content has been copied and/or is accessible on the Service in a manner that constitutes copyright infringement, or if the Service contains a link or other reference to another website, application, destination or service that contains Content or activity that infringes You may send us a notice of copyright infringement by first class U.S. mail or email, which must include the following information (as required by the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512, Limitation of Liability for Online Copyright Infringement), the text of which is available at the U.S. Notification of infringement must be sent to our Copyright Agent (DMCA Agent), as described below.

* Identify the copyrighted work that you claim has been infringed or, if a single notification relates to multiple copyrighted works on the Service, a representative list of such works on the Service.
*Identify the material that you claim is infringing (or the subject of infringing activity) and that must be removed or access to which must be disabled, and provide information reasonably sufficient to permit us to locate the material, including at least the URL of the link on the Service at which the material can be found.
*Please provide your full name and electronic or handwritten signature.
Provide reasonably sufficient contact information (including your name, postal address, telephone number, and, if applicable, email address).

Include two of the following statements in the body of the notice.
*Include a statement that you have a good faith belief that the use of the copyrighted work in the manner complained of by you is not authorized by the copyright owner, its agent, or the law, such as the following statement: "I hereby declare that I have a good faith belief that the use of the copyrighted material at issue is not authorized by the copyright owner, its agent, or the relevant law (e.g., as fair use)."
*Include a statement that the information in the notice is accurate and that the complaining party is authorized under penalty of perjury to act on behalf of the owner of the exclusive rights claimed to have been infringed. "I hereby declare that the information in this statement is accurate and that, under penalty of perjury, the complaining party is authorized to act as the owner or on behalf of the owner of the exclusive rights claimed to have been infringed."

If you do not comply with all of the requirements of Section 512(c)(3) of the DMCA, your DMCA notice may not be effective. Juniper Networks DMCA agents do not respond to any communications inquiries other than copyright notices. For communications inquiries regarding other matters, please visit the Contact Us page.

IMPORTANT: If the content or activity infringed by the notice is misrepresented, it is a violation of the DMCA and you may be liable for damages (including costs and attorneys' fees) as a result. Courts have held that you must consider copyright protections, limitations or exceptions before sending a notice. Therefore, if you are unsure whether content covered by our Services infringes your copyright, you are advised to first contact an attorney. In addition, before sending a notice, please determine whether the content to which you are sending a notice actually exists on our Service.

Repeat Infringers

Cozymoo does not condone or tolerate copyright infringement or any infringement of the intellectual property rights of Cozymoo or others, and Cozymoo reserves the right to terminate the access and/or use rights of any "repeat infringer" identified as a Cozymoo or others copyright. Cozymoo reserves the right to define the criteria for determining that a person is a "repeat infringer. If a statute, law or regulation applicable to 17 USC § 512 defines a repeat infringer, Cozymoo will use that definition as the minimum standard. Without limiting Cozymoo's right to define a "repeat infringer," as a general rule, Cozymoo will define a "repeat infringer" as any person or entity for which Cozymoo has received two or more notices of alleged infringement under the DMCA. Cozymoo will consider all relevant facts and circumstances in determining whether it is appropriate to terminate the access and/or use rights of a "repeat infringer.

Regardless of whether Cozymoo terminates access and/or use privileges of any person or entity, Repeat Infringer, or otherwise, Cozymoo will not waive any right to pursue any available remedy at law or in equity against a copyright infringer or any other infringer of intellectual property rights. Cozymoo will also not indemnify or provide legal representation to any alleged infringer in any action arising out of the alleged infringer's use of any Cozymoo Site or Services, except as expressly set forth in this Notice.

Trademark Policy

To file a notice of trademark infringement, you will need to provide us with the following information.

* Identify the trademark that is claimed to be infringed. Provide a description of the trademark, the country in which the trademark is registered, the trademark registration number, the class of the trademark, and a link (or screenshot) to the trademark registration.
*Identify the material that you claim is infringing (or the subject of infringing activity) and that must be removed or access to which must be disabled, and provide information reasonably sufficient to permit us to locate the material, including, at a minimum, the URL displayed on the Service at which the link to the infringing use of the mark can be found.
*Please provide your full name and electronic or handwritten signature.
*Provide reasonably sufficient contact information (including your name, postal address, telephone number, and, if applicable, email address).
*Include a statement that you have a good faith belief that the use of the mark in the manner complained of by you is not authorized by the owner of the mark, its agent, or the law, such as the following statement: "I hereby declare that I have a good faith belief that use of the mark is not authorized by the owner of the mark, its agent, or the law."
*Include a statement that the information in the notice is accurate and that the complaining party is authorized under penalty of perjury to act on behalf of the owner of the exclusive rights claimed to be infringed. "I hereby declare that the information in this statement is accurate and that, under penalty of perjury, the complaining party is authorized to act as the owner of the allegedly infringing mark or on behalf of the owner of the exclusive rights claimed to be infringed."
Please state, "I understand and agree that a copy of this statement may be forwarded to the user who posted the allegedly infringing content."
Submit all completed items to Juniper Networks DMCA agent at the address shown below.
Once all items are completed, send them, along with this notice, to customer@cozymoo.com.

Upon receipt of a notice of claimed infringement, Cozymoo may take steps to remove or restrict access to the allegedly infringing material.
